Terms of Service

These terms are an agreement between you and Neon Highlights, LLC (“Neon Highlights,” “we,” “us”), a Commonwealth of Virginia limited liability company. They cover the Neon Highlights website and app. By using them, you agree to what follows.

Buying merch is a separate agreement. The store at shop.neonhighlights.com runs on Fourthwall and sells physical goods under its own terms, including how returns work. Nothing here applies to an order placed there.

The short version

What Neon Highlights is

Neon Highlights is a marketplace for short youth basketball highlight videos. Independent videographers film games at tournaments, publish highlights tagged by tournament, court, game, team, and jersey number, and families find and download highlights of their player.

We are the seller of record for every purchase made through the service. When you buy credits, you are buying from Neon Highlights, LLC, not from an individual videographer.

Your account

Browsing and watching require no account. You need one to buy credits, download highlights, and keep a library. You must be at least 18 to create an account and make purchases.

You are responsible for what happens under your account. Keep your email access secure — we sign you in with a code sent to your email address, so anyone with access to that inbox can reach your account. Tell us at support@neonhighlights.com if you think someone else is using it.

You may close your account at any time by writing to us. We may suspend or close an account that breaks these terms, charges back a legitimate purchase, or is used to redistribute highlights.

Credits

Downloads are paid for with credits. One credit downloads one highlight. Credits are sold in bundles, and the current prices are shown on the credits page before you pay. We can change bundle prices, but never for a purchase you have already made.

  • Credits do not expire. If that ever changes, it will apply only to credits bought after the change, and we will tell you before it takes effect.
  • Credits are not money. They have no cash value, cannot be transferred between accounts, and cannot be exchanged for cash except as described in our refund policy.
  • Unspent credits can be refunded within 30 days of purchase. Spent credits generally cannot — see the refund policy for the exceptions, including files that turn out to be broken or mis-tagged.

Payments are processed by Stripe. We never see or store your full card number. Your card statement will show NEON HIGHLIGHTS.

What you get when you download

Spending a credit gives you a perpetual, worldwide, non-exclusive, non-transferable license to keep and use that highlight file for personal, non-commercial purposes. What you receive is the original recording at full capture resolution with no watermark — not the reduced, watermarked version streamed on the site. The file is yours to keep: it does not expire and does not stop working if you close your account or if the highlight is later removed from the site.

Personal use includes:

  • Keeping the file, backing it up, and re-sharing it on your own devices.
  • Posting it to your own social accounts — Instagram, TikTok, YouTube, wherever — including accounts belonging to the player shown or their family.
  • Sending it to family, coaches, and recruiters, including in a recruiting profile or highlight reel.

Personal use does not include:

  • Selling, licensing, or sublicensing the file, or including it in anything you sell.
  • Advertising, sponsorship, or other commercial promotion of a business or product.
  • Republishing highlights in bulk, or building any service, feed, or archive out of them.
  • Removing or obscuring credit where it is shown, or presenting the footage as your own original work.

We keep ownership of the underlying footage and of everything else on the service. Buying a download does not transfer copyright.

Acceptable use

When using Neon Highlights, do not:

  • Scrape, bulk-download, or automate access to highlights or preview streams.
  • Circumvent the paywall, share download links, or attempt to access files you have not paid for.
  • Remove, crop out, or obscure the watermark on a preview, or capture a preview and use the recording in place of buying the highlight.
  • Use the service to harass, identify, contact, or track any player, family, or videographer.
  • Upload or publish footage you did not film, or that you do not have the right to publish.
  • Interfere with the service, probe it for vulnerabilities, or overload it.

These are videos of children. Using the service to find, identify, or contact a child will end your account permanently.

Highlights, removal, and takedowns

Videographers choose which footage to publish. We do not review every highlight before it goes up, but we do remove content on request.

If you appear in a highlight, are the parent or guardian of a player who does, or believe a highlight infringes your rights, email support@neonhighlights.com with a link to the highlight and a short description. We will take it down while we look into it. You do not need to explain yourself or prove anything first.

Removing a highlight stops it being sold or streamed going forward. It does not recall files that people have already downloaded, and we cannot promise otherwise — If you ask, we will tell you whether it had been sold.

We may also remove highlights at our own discretion, or stop offering the service in a venue or region, without notice.

Availability

We do not guarantee that any particular highlight will exist, stay available, or remain purchasable. Footage depends on independent videographers being at a game and choosing to publish, and highlights can be removed at any time by the videographer, by us, or on request from someone shown in them.

The service is provided on an as-is basis. We do not promise it will be uninterrupted or error-free, and we may change or discontinue any part of it.

If you film for us

Videographers are also bound by the Videographer Agreement, which covers the license you grant us in your footage, how earnings and payouts work, and your responsibilities when filming minors. Where the two documents conflict on a videographer matter, the Videographer Agreement controls.

Disclaimers and limits

To the fullest extent the law allows, Neon Highlights, LLC disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

To the fullest extent the law allows, our total liability to you for any claim relating to the service is limited to the greater of the amount you paid us in the twelve months before the claim, or one hundred US dollars. We are not liable for indirect, incidental, or consequential damages, including lost footage or missed moments.

Some jurisdictions do not allow these limits, in which case they apply to you only as far as permitted.

Governing law

These terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict-of-laws rules. Any dispute will be brought in the state or federal courts located in Virginia, and you and we each consent to that jurisdiction.

Changes to these terms

We may update these terms. When we make a material change, we will update the effective date at the top and, if you have an account, tell you by email before it takes effect. Continuing to use the service after that means you accept the updated terms.
