Videographer Agreement

Nothing here creates an employment relationship, partnership, or joint venture. You are an independent contractor running your own activity.

• You choose which events to attend, when to film, and how much to shoot.
• You use your own equipment.
• You pay your own costs, including entry or ticket fees at tournaments that charge for admission, and any travel.
• We do not set your hours, guarantee you work, or pay you a wage.
• You get no employee benefits, insurance, or worker’s compensation from us.
• You are free to film for anyone else, including competitors.

You are responsible for your own taxes. We do not withhold anything from your earnings.

Whether you earn from your highlights is your choice, and you make it by setting up payments. Both options are fine, and you can switch at any time.

• With payments set up, you earn 50% of every sale of a highlight you filmed. We keep the other 50%, which covers payment processing, storage, video delivery, and running the marketplace.
• Without payments set up, you earn nothing. You can still publish, and we may still sell your highlights to families and keep the full amount. Some videographers prefer this — no tax paperwork, no Stripe onboarding, or a team is already paying them to film.
• You can change your mind at any time. Set up payments and you start earning on sales from that point forward. It does not apply to highlights already sold while you were not set up.
• Rounding goes in your favor when a split lands on a fraction of a cent.
• Refunds reverse the split. If we refund a purchase, your share of that sale reverses. If it has already been paid out, it comes off your next cash-out balance.
• We may change the split, but never retroactively. Sales made before a change settle at the old rate, and we will tell you before a new rate takes effect.

Once payments are set up, your earnings and every individual sale are visible in the app. If our numbers and yours disagree, write to us and we will show you the underlying records.

Payouts run through Stripe. Before you can be paid you will complete Stripe’s onboarding, which collects your identity, tax details, and bank account directly. We never see or store your bank details or government ID.

• You cash out when you want. There is no payout schedule and no minimum.
• Sales become available after 7 days. Recent sales do not count toward your cash-out balance until they have aged, because a buyer can dispute a charge after the fact. This protects you from having a payout clawed back later.
• Tax forms. If your earnings pass the reporting threshold in a calendar year, you will receive the appropriate tax form. Keeping your tax details current in Stripe is your responsibility.
• Unclaimed earnings do not expire. If you stop filming, your balance stays yours and you can cash it out later.

You keep ownership of everything you film. We are not buying your copyright.

By publishing a highlight, you grant Neon Highlights, LLC a worldwide, non-exclusive, royalty-free license to host, stream, reproduce, distribute, and sell downloads of that highlight through the service, and to promote the service using short excerpts. This license lasts while the highlight is published, plus what is necessary afterward to honor downloads already sold.

We show a watermarked preview, and sell the original. That license includes making a reduced-resolution copy of your highlight with our mark across it, which is what anyone who has not bought it sees. Buyers receive your footage as you filmed it: full resolution, no watermark, unaltered. We make no other changes to your work, and the preview exists for one reason — so that what you filmed is worth paying for rather than worth screen-recording.

You may unpublish a highlight at any time. Doing so stops future sales and streaming. It cannot recall files buyers already downloaded, and the license for those already-sold copies survives.

You may use your own footage anywhere else. It is yours.

Each time you publish, you confirm that:

• You filmed it. The footage is yours, not sourced from a broadcast, another videographer, or any other recording.
• You were allowed to be there and to film. You have observed the venue’s and the event organizer’s rules on filming, and you were not asked to stop.
• The tags are accurate — tournament, court, game time, team, and jersey number to the best of your knowledge.
• The footage shows gameplay at an organized event, and nothing else.

Almost everyone you film is a child. Breaking any of the rules below ends your account.

• Film the game. Publish gameplay. Do not publish footage focused on individuals off the court, on spectators, or on anything unrelated to play.
• Do not identify players. Never tag, caption, or describe a player by name. Highlights are identified by jersey number and team.
• Do not contact players or families that you meet through Neon Highlights, and never use footage or the app to find, follow, or reach a child.
• Stop when asked. If a parent, coach, official, or venue staff member asks you to stop filming or to remove footage, stop immediately, whether or not you agree with the request.
• Respect venue rules. Some tournaments and facilities restrict or prohibit filming. It is your responsibility to know and follow the rules where you are.

We will remove any highlight on request from someone shown in it or their guardian, without asking them to justify it. We will not ask you first.

We may unpublish any highlight, and suspend or close your account, at our discretion — including for inaccurate tagging, footage that is not yours, complaints about your conduct at an event, or anything in the section above.

You can stop at any time. Earnings you have already accrued remain yours and stay available to cash out, except where they relate to footage that turns out not to have been yours to publish.

You are responsible for your own conduct at events and for the footage you publish. If a claim is brought against us because footage you published was not yours to publish, or because of how you behaved at an event, you agree to cover the costs we reasonably incur as a result.

Our liability to you is limited to the earnings owed to you at the time of a claim. We are not liable for lost footage, missed events, or income you expected to earn.

We may update this agreement. Material changes will be sent to the email on your account before they take effect, and the effective date above will change. Continuing to publish afterward means you accept the update.

This agreement is governed by the laws of the Commonwealth of Virginia, without regard to its conflict-of-laws rules.
